When you purchase a service from Family History Journey the following terms and conditions will apply, together with those listed on the left.
- You are strongly advised to read them in full, and to ask if there is anything you are unsure of or do not understand.
- There are sections below for: Family History Tree Services, Family History Tour Services and Other Research Services corresponding to the service tabs above.
- Family History Journey reserves the right to amend and/or change any or all of these terms and conditions without warning. You are strongly advised to review them periodically, and especially when placing a new request for a service or making a new payment. Every effort will be made to ensure that any changes to the terms and conditions do not affect current clients and customers, that is, those who have a purchased a service, in part or in full, but have not yet received that service in full.
- Family History Journey is based in England and subject to English law and jurisdiction.
Family History Tree Services
- By requesting and paying for a Family Tree Package service offered by Family History Journey you agree to the following terms and conditions in addition to others on this page and on this site.
- Please make sure that you have read the description of the package you intend to purchase in full, and that you have understood what is being offered and which sources of information will be consulted. If you are unsure, please ask.
- Whilst Family History Journey will exert every effort within budget to identify your ancestor(s), and locate information about them, success cannot be guaranteed. You will be advised as quickly as possible if this is the case, and provided with the reasons. If any solutions to the deadlock are thought possible (eg more time, additional archive research) you will be advised accordingly, and, if appropriate, costed. No step will be taken without your prior permission. When considering whether a refund is due, Family History Journey will need to take into account how much research time and expenditure has already been committed to the effort.
- Before booking please be ready to uncover something about your family that you or another family member may prefer in hindsight not to have known. While family history is usually a process of discovering wonderful and enlightening facts about your ancestors, it can sometimes uncover disturbing or distressing facts.
- Every effort is made to provide you with accurate information about your ancestry and your ancestors. 100% accuracy cannot be guaranteed. Even official documents can be inaccurate and/or misleading. Genealogical research is a process of evaluating the information available and reaching an informed conclusion. Family History Journey will provide you with a research report, which will include the sources of information and include any possible areas for doubt, uncertainity or ambiguity. You will also receive copies of the available documents. The results will be Family History Journey's professional conclusion.
- Family Tree research can only begin with information you provide. Family History Journey cannot be held responsible if that information is, for any reason, inaccurate or misleading. It is important for you to give as much information as possible, including how and/or from where you obtained that information. Family History can then evaluate its possible accuracy and relevance. If you choose not to disclose all the information you have about an ancestor (and you may have your reasons), please do keep in mind that Family History Journey may duplicate research already conducted and only provide you with knowledge you already have. If you are unsure about the accuracy or relevancy of any information, don't worry, it is better to disclose it so that Family History Journey can make a determination and proceed accordingly.
- Sometimes Family History Journey will ask you for additional information that may seem to you irrelevant, such as, and not limited to, the first names of siblings or cousins. The relevance of the request should always be explained to you and it will be entirely up to you to whether or not to disclose it.
- In the course of researching your family tree, Family History Journey may come across research already conducted by a distant member of your family. Whilst this can be helpful, Family History Journey will not and cannot assume this research to be accurate. Family History Journey will check every stage of that research and communicate the results only to you. This will be considered a part of the Family Tree package you have purchased, and not a means by which a short cut can be made.
- Family History Journey cannot guarantee how long it will take to complete Family Tree research. Average completion time is 6-10 weeks from when you pay the deposit, but it may take longer. If it will take longer, you will receive a report about the sources consulted to date and the reasons why the research is taking longer than average. If you have a deadline, such as an event, please make this known when making your booking request. If Family History Journey accepts the deadline, every effort will be made to meet it, but it cannot be guaranteed.
- On completion of Family Tree research, any outstanding payments must be made and then the results will be sent in the agreed format. Family History Journey reserves the right to withold all or some of the research results if any balance is outstanding. Please ensure that you have read and understood the Payments, Refunds and Cancellation policy to the left of this page.
- Publishing the results: Family History Journey will not reproduce or publish the results of any research commissioned by you or conducted on your behalf without your prior permission. If you decide to publish the results on the web, in print or anywhere else, you should acknowledge that the research was conducted by Family History Journey. Remember that you should not publish information about living persons without their prior explicit permission. Family History Journey does not advise publishing information about living persons even if they have given their consent.
Family History Tour Services
- The person booking a tour(s), accommodation(s), a transfer(s) or transport with Family History Journey on behalf of others undertakes and accepts reponsibility for ensuring that they are aware of, and accept, the responsibilities, risks, terms and conditions as outlined above and below.
- Family History Journey acts only as the client or customer's representative (agent) with respect to transportation and accommodation/s, and exercises every care possible. Its owners, staff, and representatives (including local historians and any other persons or vendors connected with a tour or other service booking) shall not under any circumstances be liable to the client, or by any reason be responsible directly or indirectly, for any accidents, injury, delay, damage or inconvenience caused to the clients, customers or participants by the negligence of others: by malfunctions of transportation, systems or equipment, by changes or cancellations, or by other causes beyond the control of the above persons' control. The client, customer and participants hereby release the above persons from any and all such liability.
- Any and/or all transportation companies used shall not have or incur any responsibility to any traveller aside from their liability as common carriers.
- All baggage, luggage and personal items are entirely the owner's responsibility and risk.
- By confirming acceptance and paying a deposit, clients and customers certify that they, or any of their party, do not have any mental, physical or any other condition or disability that would create a hazard to themselves or others.
- Family History Journey tour participants realize that by entering and walking around historic places or buildings, there may be associated hazards, such as, and without limitation, rough terrain, uneven pathways, uneven floors, and low ceilings, and accept the responsibility and risks associated with such activity. In consideration of, and as part payment for, the right to participate in such activity, participants agree to assume all of the above responsibilities and risks and further agrees that such payment shall also constitute consent to all provisions in this document.
- Family History Journey makes no guarantee to clients, customers and participants as to the number and quality of historic sites that are present or available in any given place.
- Clients, customers and participants may be asked to agree to additional liability waivers, such as, and without limitation, in the event that they wish to access an historic building not usually open to the public and which therefore does not have public liability insurance. Such agreements will usually require a signature.
- Cancellation policies and fees: please refer to the Payments and Refunds Policy page.
- Clients and customers are also strongly advised to familiarize themselves with all Family History Journey terms, conditions, policies and procedures listed to the left.
- Insurance, including trip cancellation insurance, is highly recommended.
- Finding and exporting historic objects: under English law, landowners have sole title to any archaelogical/historical artifacts found on their property. They may be open to negotiation. Metal finds, such as coins and jewellrey, are subject to the Treasure Act 1996 which obliges finders to report their find to a local coroner within 14 days. If the find is found to be treasure, it must be offered for sale to a local museum. If the offer is declined, then it may be retained by the finder, but an export license may need to be applied for and awarded before historic artefacts can taken out of the country.
Other Family History Research Services
- By requesting and paying for a research or personal history service offered by Family History Journey, you agree to the following terms and conditions in addition to others on this page, on this site and communicated to you in writing - whether by email or ordinary mail.
- Please make sure that you have read the description of the service you (intend to) purchase on this website or in any email correspondence in full.
- Genealogy researcher services, including advisory, checking, archive record and document research: please read the Terms and Conditions for Family History Tree packages above. The main difference by booking a researcher directly is the sources that could be consulted and the format of the results, all of which will be agreed with you prior to any step being taken. Particular terms and conditions may apply and will be communicated to you in writing before any research on your behalf begins.
- Personal history / lifestory / oral history recording services: all the details, including terms, conditions and price, will be communicated to you prior to the project beginning. Importantly, you should seek to understand that the quality of the recording will depend on what you ask for. The quality of a basic visual recording will differ considerably from a visual recording employing greater production values.
